The costs of mediation will be shared equally between the parties unless otherwise agreed.

Arbitration

If mediation does not result in a resolution, any disputes arising out of or relating to these Terms of Use or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration will be conducted in Oklahoma City, Oklahoma, and will be conducted in English. The arbitrator's decision will be final and binding, and judgment may be entered upon it in any court of competent jurisdiction.

Exceptions

The dispute resolution procedures above do not apply to disputes involving intellectual property rights, claims for injunctive relief, or disputes that may be brought in small claims court.

Class Action Waiver
